Terms and Conditions

Article 1 – Definitions

Cooling-off period: the period within which the consumer may exercise the right of withdrawal.

Consumer: the natural person who is not acting in the course of a profession or business and who enters into a distance agreement with the entrepreneur.

Day: calendar day.

Extended transaction: a distance agreement relating to a series of products and/or services, the delivery and/or purchase obligations of which are spread over time.

Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.

Right of withdrawal: the possibility for the consumer to cancel the distance agreement within the cooling-off period.

Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.

Distance agreement: an agreement concluded within a system organized by the entrepreneur for distance selling of products and/or services using one or more means of distance communication.

Means of distance communication: any means used to conclude an agreement without the consumer and entrepreneur being in the same place simultaneously.

Terms and Conditions: the present Terms and Conditions of the entrepreneur.

Article 3 – Applicability

These terms apply to every offer made by the entrepreneur and to every distance agreement and order concluded between the entrepreneur and the consumer.

Before a distance agreement is concluded, the text of these terms will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate where the terms can be inspected and that they will be sent free of charge upon request.

If the agreement is concluded electronically, the terms may be provided electronically in such a way that they can easily be stored by the consumer on a durable data carrier.

If additional product or service conditions apply, the consumer may always rely on the provision that is most favorable to them in the event of conflicting terms.

If one or more provisions of these terms are invalid, the remaining provisions remain in force and the invalid provision will be replaced by a provision that reflects the original intent as closely as possible.

Situations not covered by these terms shall be interpreted in the spirit of these terms.


Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be clearly stated.

The offer is non-binding. The entrepreneur may modify the offer.

Product descriptions are complete and accurate to allow proper evaluation by the consumer. Images represent the products truthfully but slight differences (such as color) may occur.

Obvious errors or mistakes in the offer are not binding.

Each offer contains information that makes clear the rights and obligations related to acceptance of the offer, including:

  • the price (excluding import VAT and customs clearance costs);

  • shipping costs if applicable;

  • the way the agreement will be concluded;

  • whether the right of withdrawal applies;

  • payment, delivery and execution methods;

  • the period for accepting the offer;

  • possible communication costs;

  • whether the agreement will be archived;

  • how the consumer can review and correct data;

  • possible languages in which the agreement can be concluded;

  • applicable codes of conduct;

  • minimum duration of the agreement if applicable.


Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer and meets the conditions set.

If acceptance occurs electronically, the entrepreneur will confirm receipt electronically without delay.

The entrepreneur will take appropriate security measures for electronic data transfer and ensure a secure web environment.

The entrepreneur may investigate whether the consumer can meet payment obligations and may refuse an order or attach conditions if justified.

Every agreement is concluded subject to product availability.


Article 6 – Right of Withdrawal

Consumers may cancel a purchase within 14 days without giving any reason.

The cooling‑off period starts the day after the consumer receives the product.

The consumer must handle the product carefully during this period and return it in original condition where possible.

To exercise the right of withdrawal, the consumer must notify the entrepreneur within 14 days via written message or email and return the product within 14 days thereafter.

If the consumer fails to notify or return the product within the required timeframe, the purchase becomes final.


Article 7 – Costs in Case of Withdrawal

Return shipping costs are the responsibility of the consumer.

Any payments made will be refunded within 14 days after withdrawal, provided the returned product has been received or proof of return shipment has been supplied.


Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for products:

  • made according to consumer specifications;

  • clearly personal in nature;

  • that cannot be returned due to their nature;

  • that spoil or expire quickly;

  • whose price depends on financial market fluctuations;

  • newspapers and magazines;

  • audio/video recordings or software with broken seals;

  • hygiene products whose seal has been broken.


Article 9 – Price

Prices will not increase during the validity period stated in the offer, except due to changes in VAT rates.

Prices may vary if dependent on financial market fluctuations beyond the entrepreneur's control.

All prices are subject to printing and typographical errors.


Article 10 – Conformity and Warranty

The entrepreneur guarantees that products comply with the agreement and reasonable requirements of reliability and usability.

Any defects must be reported in writing within 14 days after delivery.

The warranty does not apply if products:

  • have been repaired or modified by the consumer or third parties;

  • have been exposed to abnormal conditions;

  • were used contrary to instructions.


Article 11 – Delivery and Execution

The entrepreneur will take the greatest possible care when processing orders.

Delivery takes place at the address provided by the consumer.

Orders will be executed as soon as possible and no later than 30 days, unless otherwise agreed.

If delivery is delayed or impossible, the consumer will be informed and may cancel the order without cost.


Article 12 – Duration Transactions

Consumers may terminate agreements of indefinite duration at any time with a notice period of up to one month.

Agreements with a fixed term may be terminated at the end of the term with a notice period of up to one month.


Article 13 – Payment

Payments must be made within 7 working days after the cooling‑off period begins unless otherwise agreed.

Consumers must immediately report inaccuracies in payment details.

In case of non‑payment, the entrepreneur may charge reasonable costs permitted by law.


Article 14 – Complaints Procedure

Complaints must be submitted within 7 days after the consumer discovers the issue.

Complaints will be answered within 14 days after receipt.

If a complaint requires more time, the consumer will receive confirmation and an estimated response time.


Article 15 – Disputes

All agreements between the entrepreneur and the consumer are governed exclusively by USA law, even if the consumer resides abroad.
